Suddenly, he was kicked and fell face down on the ground. Plaintiffs saw a set of the defendant P.O.s Edward Madden, Robert O'Neil, William Ditomaso, Matthew Kudow, John and Jane Does 1-10 standing over him. The officers kicked plaintiff all over his body while he was lying on the ground, and plaintiff fell unconscious. When plaintiff awoke in the hospital, he noticed that despite his condition, he was physically restrained to his hospital bed and that some of the defendant officers were on guard at his bed. The officers claimed he was being detained because he had committed theft. The defendant officers and defendant Jamaica Hospital Medical Center (JHMC) cooperated to keep plaintiff detained in the hospital without probable cause. Defendant JHMC did not provide adequate medical care. Defendants JHMC, Renaldo Punsal, MD, and Jeffrey Chan, MD forcibly removed the suction tubes from Plaintiff's side and discharged plaintiff into the custody of defendant officers. \n\nPlaintiff was arraigned on March 18, 2013 on charges of petit larceny and criminal possession of stolen property. He was transported to Rikers Island but was soon rushed to Bellevue Hospital because he relapsed into a medical emergency due to his earlier, premature discharge from the hospital.
