Defendant Vazquez then took plaintiff inside of the 28th Precinct, where he and defendant officers McGuire and Brightman continued to assault and beat plaintiff while he was restrained.\n\nWhile in custody, plaintiff was transported to St. Luke’s Hospital, where he was treated for the injuries such as flank pain, joint pain, abrasions on both wrists, and hematuria. Charles Stokes was punched, kicked, thrown to the ground, struck on the top of his head, face, eyebrow, side of his face, knees and hands, causing bleeding, laceration, spinal derangement, and derangement of his arms and legs. He was handcuffed, falsely arrested, and held against his will. In addition, defendants were verbally abusive. As a result Charles Stokes suffered severe personal, emotional, injuries and special damages. \nPlaintiff Aaron Stokes was unlawfully arrested, held and searched by the defendants without probable cause. He was further subjected to improper imprisonment, illegal detainment, torture and unnecessary force. In addition, in retaliation for recording and photographing the defendants actions as they beat and assaulted other individuals including Charles Stokes, the defendants destroyed plaintiff Aaron Stokes cell phone. Defendants either actively participated in the excessive force or were present and improperly failed to intervene to prevent other officers from using said force. As a result, Aaron Stokes suffered serious and severe emotional injuries and special damages.
