MICHAEL WERNER, and DET. ANDERSON WALCOTT arrived in the hallway in front of plaintiff BRYAN HEDIAN’s apartment at 546 W. 164th Street, Apt. 1G, New York, New York, 10032, without an arrest warrant or search warrant. Defenadts entered the apartment without OLIVER HEDIAN’s permission. Defendants knocked OLIVER HEDIAN down, then beat, kneed, handcuffed, and dragged him from the apartment into the hallway. WENDEL HEDIAN was handcuffed and punched five times in the back of his head, causing lacerations, and jabbed with a hard object on the ribs and head. WENDEL HEDIAN had a panic attack during the incident. A police officer then pulled plaintiff WENDELL HEDIAN up by his handuffs and pushed him toward a detective. Defendants harrassed, questioned, frisked, and handcuffed BRYAN HEDIAN. BRYAN HEDIAN was then escorted outside of the building and interrogated. He was told by defendants that they would “fuck him up if they found anything” as they search his Appartement. The plaintiffs were illegally confined in a van outside of his apartment without consent and then taken to the 33rd precinct. Plaintiffs were interrogated. There, they were handcuffed and placed in a jail cell for several hours and then transferred by the defendants to the Manhattan Roberry Squad Stationhouse. BRYAN HEDIAN was handcuffed to a chair. Then, they were interrogated and fingerprinted. Plaintiff OLIVER HEDIAN was then arraigned and later released on bail. After the first illegal entry, various police officers illigaly entered the apartment even though the police had no cause to believe that they had engaged in any criminal conduct. A police officer escorted plaintiffs BRYAN and WENDELL HEDIAN to the clerk’s office and gave him a letter stating that the prosecutor’s office declined to prosecute him. Defendats illegally entered the apartment. Seized and never returned approximately $2000 in cash of the plaintiff BRYAN HEDIAN located in his mother's room, and $1000 from OLIVIER HEDIA, an iPhone 4, iPod, and Techno Master. Never received a voucher for his ring. Broke a 46’’ television, removed mattresses from beds, and otherwise damaged the plaintiffs’ apartment.
