They did not have any issues with neighbors except for Kevin Sullivan, the boyfriend of their next door neighbor, who moved there a year or so after they did. Mr. Sullivan would harass and harangue them (including by threatening to call the police), with the main contention being the shared driveway between the properties, which the plaintiffs lawfully had access to. Mr. Sullivan eventually called the police in 2008 and, without listening to plaintiffs or inspecting property records, the police told plaintiffs they could not park their vehicle in the driveway. Going forward, the plaintiffs did not use the driveway, but Mr. Sullivan began to place garbage, debris, and construction debris in the driveway, and later into the plaintiffs' trash cans and front lawn. Eventually, Ms. Bailey called the police who did not do anything about the cinderblocks and debris directly in front of her home, instead telling her to move it by herself.\n\nOn May 10, 2011, Ms. Bailey's adult son, Mr. Webster, visited the home and parked his car in the driveway. Mr. Sullivan began tossing garbage bags next to and on top of Mr. Webster's car, leading Mr. Webster and Mr. Sullivan into a verbal dispute. Mr. Sullivan called Mr. Webster a \"n*****\" and demanded the family get out of the neighborhood, move back to \"their country,\" and threatened to call the police to have them shot or locked up. Ms. Bailey called for her son to come inside, at which point many people in the neighborhood had come outside their houses. Mr. Sullivan seemingly then called the police as they arrived soon after and went directly to his place. They then arrested Ms. Bailey and Mr. Webster, based on Mr. Sullivan's false claims that they had assaulted him and chased him with a machete. The officers did not ask plaintiffs or any of the neighborhood witnesses about the incident. Upon arrest, the two were charged with assault, menacing, and harassment by the Kings County DA. Because of their immigration status, plaintiffs' attorneys (allegedly provided by Legal Aid) erroneously advised them to plead to disorderly conduct to avoid immigration consequences. The next year, in May 2012, Mr. and Ms. Bailey were in their yard when Mr. Sullivan began verbally berating them. Ms. Bailey called the police, but when they arrived, they refused to take a statement from her and instead spoke to Mr. Sullivan only. They (including Officer Vadim Kontorovich) then came to the Baileys' residence, asked why the Baileys were causing trouble in a nice neighborhood, and forcefully arrested her, throwing Ms. Bailey against the wall, traumatizing their 10 year old daughter, N.B., who is now diagnosed with PTSD. \n\nMs. Bailey was immediately turned over to ICE and placed in Removal Proceedings, where she remained in custody for several months. At the time of the arrest, plaintiff was not told what he was being arrested for and was handcuffed too tightly. Officers Ardito, Kontorovich and Smith ignored these complaints. \n\nThe officers Officer Pasiecnzik  and Sergeant McCormack never got a signed statement from the injured person, Ms. Drapinski. Detective Vadim Kontorovich nonetheless signed an affidavit affirming that Ms Drapinski stated plaintiff had pushed her.
