Officers placed handcuffs on Plaintiff and placed him in the back of a police vehicle. Officer Branch purposely banged Plaintiff's head against the vehicle's doorframe and laughed. Officer Branch made racially disparaging remarks to Plaintiff during their ride to the precinct. \nAt the precinct, Plaintiff was placed in a cell. Officer Branch snatched Plaintiff's phone out of his hand once Plaintiff unlocked the phone and after Plaintiff had denied providing the officer his phone password. Plaintiff requested his phone back, the request was ignored, and Plaintiff grabbed the phone back from Officer Branch. Officer Branch grabbed Plaintiff, shoved him into the back his cell, pulled his shirt up, then choked Plaintiff with it. Plaintiff attempted to remove Officer Branch's hands from his neck, then Officer Branch kicked and hit Plaintiff repeatedly in his head, back, and shoulder. Officer Branch also placed his knee on Plaintiff's back and spine. Officer Branch was aided by other NYPD officers in this assault. Plaintiff was tased as part of this assault. \nAfter the assault, officers placed handcuffs and shackles on Plaintiff extremely tightly, resulting in pain and nerve damage to Plaintiff's wrists and ankles. \nAn unknown officer approached Plaintiff and screamed derogatory and racist statements at him. Plaintiff repeatedly requested medical care, but his requests were ignored. Plaintiff spent two days at the Precinct before being transferred to Central Booking. At Central Booking, Plaintiff was transferred to the hospital where he received treatment for significant trauma to his head and other parts of his body and an MRI was conducted. \nPlaintiff was charged with crimes which he denies. At arraignment, Plaintiff was remanded to Riker's Island where he was assaulted five times by inmates and corrections officers. After the arrest, the plaintiff was placed in extremely tight handcuffs and put in a police vehicle, where he suffered assaults and humiliation from Defendant Branch. At the precinct, Defendant Branch gave the plaintiff his phone and encouraged him to use it, only to snatch it away after the password was entered, thereby avoiding compliance with the 4th Amendment’s search warrant requirements. The plaintiff's request for the return of his phone was ignored, and he was further assaulted by Defendant Branch and other John Doe officers, who shoved, choked, kicked, and hit him while making racist statements. The plaintiff was also tased at the precinct, and the cuffs and shackles were extremely tight. After nearly two days in the precinct, the plaintiff was transferred to Central Booking and then to Presbyterian Hospital to receive medical treatment for his injuries. Defendant Branch provided false information to the NY County District Attorney, resulting in the plaintiff being charged with assault in the 2nd degree for allegedly assaulting Defendant Branch. At arraignment, the plaintiff was remanded and sent to Riker's Island, where he was assaulted five separate times by inmates and correction officers. As a direct result of the false arrest, the plaintiff was illegally detained for approximately 40 days.
