Defendant Officer pushed Plaintiff face down on the floor, tightly handcuffed him and forcibly removed him from the bedroom and put him into a police vehicle. Officers kept the gun pointed at Plaintiff's spouse who was in her underwear and their children. Plaintiff's spouse was searched including her scalp and hair bonnet and was not allowed to put on her clothes or to dress her children until after the search. The Officers conducted a destructive search of their home. The Driver of the police vehicle in which Plaintiff was illegally seized received a call after which the Defendant Officers brought Plaintiff back to his home, pulled him out of the car, uncuffed him, and told him to tall 311 about the battered door and other destroyed property. Defendant Officers unreasonably believed based on false and unreliable information that Plaintiff's home was where evidence or instrumentalities of crimes would be found and deployed 17 armed and outfitted officers to forcibly enter, seize, and search Plaintiff's apartment. As a result of the Officers misconduct, Plaintiff suffered loss of liberty, mental anguish, emotional distress, physical pain, embarrassment, humiliation, loss of services, interference with employment and relationships. While inside the business, the officers pointed a shotgun at one of Baijnauth's employees, destroyed the surveillance system and walls, and stole cash and jewelry. After his employee told him about the incident, Baijnauth and his wife, Meenakshi, went to the precinct for information. An officer told Meenakshi that there was a no-knock warrant for the premises on the belief that the Baijnauth's were selling guns and drugs out of the basement. The officer also accused Meenakshi of buying stolen jewelry. On March 29 and April 1, a woman believed to be working for the police came to the Baijnauth business sold jewelry to Baijnauth's employee. At no time was it known that the jewelry was stolen.\n\nOn April 21, 2017, Officers Allen, Beck, Vega, and Roach entered the Baijnauth business after an undercover officer sold jewelry to an employee. The employee unlocked his phone to show a picture of the buyer's ID, at which point Officer Beck deleted the picture. While alone inside the residence, the plaintiff heard a noise at the door.  When he opened the door, he saw the NYPD defendants, specifically Officer Budney and Detectives McCarthy, Halinski, Erlich, McGuinness, Difrancessa, Hefner, and Gezurian.  The NYPD defendants entered the residence and subjected the plaintiff to several forms of physical force, including pushing him against the wall, punching his back, kicking him when he fell to the floor, and punching his face, causing a bleeding lip.  As a result, the plaintiff suffered physical injury.  The NYPD defendants took the plaintiff to a precinct where he remained in custody before his transfer to a booking facility.  The plaintiff was unable to go to a hospital to treat his injuries until the following day.
