Carlos Lewis and POs Donald Sadowy, Gamalier Baez, and potentially John Does 1-10, who asked Plaintiff if they could search the car. Plaintiff declined and POs ordered Plaintiff to exit the car, raise his hands, and stand at the rear of his vehicle. Plaintiff complied and two POs proceeded to illegally search his person and two POs illegally searched his car. After approximately 15 minutes POs released Plaintiff without summons or charges. Approximately 15 minutes later Plaintiff saw the same POs in a different area. Plaintiff lawfully parked his car, approached, and asked them for their badge numbers. One PO responded \"1-2-3 fuck you boy\" and approximately 4 POs exited the police vehicle, aggressively surrounded Plaintiff, grabbed Plaintiff, shoved him against the police vehicle, and handcuffed Plaintiff. Once Plaintiff was handcuffed POs threw Plaintiff to the ground and proceeded to repeatedly punch and kick Plaintiff about his head and torso without legal justification. \n\nPlaintiff was then brought into the vehicle and forced him to lay face down on the floor of the van. POs then applied extreme pressure to Plaintiff's legs for approximately 30 seconds, intentionally causing Plaintiff severe pain. A PO asked Plaintiff \"You think you are tough? Let's see just how tough you are.\" The PO then forced Plaintiff to open his mouth, placed his NYPD firearm inside Plaintiff's mouth, counted to three, and pulled the trigger. Once the gun was removed from Plaintiff's mouth Plaintiff told the POs he was going to file a complaint against them. In response the POs told him to \"shut the fuck up\" and proceeded to punch Plaintiff about his head and torso. \n\nPlaintiff was then illegally transported to the 73rd Precinct, where POs intentionally shoved handcuffed Plaintiff into a holding cell, causing Plaintiff to lose his balance and fall head-first into the wall. After several hours Plaintiff was transported to the hospital where he received several staples to his head laceration and treatment for pain to his head, back, and right elbow. Plaintiff was then taken back to the 73rd Precinct where POs intentionally and falsely forwarded false information to initiate a malicious prosecution against Plaintiff. After approximately 18 hours in custody Plaintiff was released. The officers approached the stopped car with their weapons drawn and shattered the driver's side window. Plaintiff was pulled from the front passenger seat by one or more of the officers and he was struck in the head with a baton. At no point did the officers observe Plaintiff do anything illegal. Plaintiff was treated at the hospital for injuries inflicted on his skull, jaw, face and neck. He was then taken to the precinct and to Central Booking. The officers prepared a false police report accusing Plaintiff of crimes he did not commit and made false statements to the DA's Office. On or about January 24, 2014, the charges were dismissed and sealed.
