Plaintiff feared that Defendants would brutally assault and batter Plaintiff if he did not run away, so Plaintiff ran approximately half of a block away.  Defendants eventually caught up to Plaintiff and then punched Plaintiff on the right side of his head and continued to repetitively hit Plaintiff with their batons. Defendants then placed Plaintiff under arrest without legal justification or probable cause by grabbing Plaintiff off of the ground about his body and extremities before violently contorting his arms behind his back and affixing zip ties to his wrists in an excessively tight fashion. As a result, Plaintiff’s wrists hemorrhaged. Plaintiff also sustained contusions, swelling, and loss of feeling to his wrists, hands and arms.  As a result of the false and fabricated statements and allegations provided to prosecutors by Defendants, Plaintiff was falsely charged with a misdemeanor of Violating An Emergency Order. Defendants intentionally provided said false information to the District Attorney’s Office, so that a criminal prosecution would be initiated against Plaintiff namely that Plaintiff violated an emergency order.
