Officer Sean Rafferty approached and said he was parked too close to a fire hydrant. When Plaintiff moved his vehicle and exited, Rafferty approached again demanding driver's license and asking Mr. Tertus if he had been drinking or smoking marijuana. Mr. Tertus said no. Plaintiff had two unopened cans of beer on the floor of the front passenger seat and Rafferty arrested him. At the 112th precinct, Mr. Tertus registered 0.00 on a breathalyzer and a urine sample later failed to detect presence of drugs. However, Officer Anthony Spedaleri reported Plaintiff inadequately performed the coordination test, though it was unclear if Mr. Tertus (who is not a native English speaker) understood his instructions. Mr. Tertus was charged with driving while ability impaired by drugs, disorderly conduct, and for intentionally causing public inconvenience, annoyance or alarm, or recklessly creating a risk thereof by obstructing vehicular traffic.
