Across the street, a fight broke out among a bunch of women in front of a bar called La Linea.  The fight spilled over to the side of the street where One and One was located. Plaintiff worked as a bouncer at One and One, but was not working that night. He and the bouncer on duty attempted to break up the fight, but unbeknownst to him, two of the fight participants were plain clothed police officers. Plaintiff did not assault or strike any officers, but when several uniformed officers arrived, they threw Plaintiff to the ground and hit him, kicked him, and pepper sprayed him. Plaintiff and the bouncer were both arrested and Plaintiff was charged with felony assault on a police officer and resisting arrest. Plaintiff was eventually taken to a police precinct where the officers filed a police report with the false allegations. Plaintiff was held for approximately twenty four hours before he saw a judge at criminal court. The judge set bail, but Plaintiff could not pay, and Plaintiff was held at Rikers Island for approximately seven days.
