Police officers arrested both plaintiffs, and when Joey Fernandez asked why, he was pushed to the ground and punched and then taken into a police car. Joey was then put in a chokehold inside the police car. On his way to the precinct, Joey was further brutalized by police officers. Police officers also called Joey a \"faggot\", a \"dickhead\", and accused him of being part of a gang. Once in custody, Joey was told to \"shut the fuck up\" multiple times. Plaintiff lawfully crossed the street to approach his friend to inquire why the sergeant was ticketing her. A police officer ordered claimant to leave the immediate area, and Plaintiff complied, walking back to where he originally stood. Approximately 15 minutes later, the sergeant ticketing Plaintiff's friend approached Plaintiff and ordered him to place his hands behind his back. When Plaintiff asked why he was being arrested, the sergeant pointed a taser at Plaintiff's face and did not tell him why he was being arrested. The sergeant criticized Plaintiff's friend who the sergeant ticketed for dating an \"African American\" man, implying it was beneath her to date Plaintiff. The sergeant unlawfully placed Plaintiff in dangerously tight handcuffs without probable cause or reasonable suspicion and pushed him into a cramped vehicle. Upon arriving at the 42nd Precinct, Plaintiff was assaulted and battered when Police Officer Rene Calzada and four unknown police officers violently and forcefully dragged Plaintiff out of the car by the handcuffs and violently slammed him to the pavement twice, causing pain and injury to Plaintiff's hand, back, and wrists, causing him injuries, aching, pain, sprains, and strain and breaking the screen of Plaintiff's phone. Officers refused to tell Plaintiff why they were attacking and arresting him. Plaintiff was detained for approximately seven hours before being released and given a summons for disorderly conduct. Officer Calzada signed the summons containing false and untrue allegations fabricated by defendants. The summons was dismissed on May 6, 2014 after Plaintiff endured five months of malicious prosecution. Officers arrived and asked Plaintiff Rhodes to step outside the premises to speak with him. Plaintiff declined and without any justification the Officers reached into the subject premises and physically pulled Plaintiff Rhodes outside the subject premises. NYPD Officer Rene Calzada subsequently placed Plaintiff Rhodes into an illegal chokehold. While in a chokehold, NYPD Officer Eddie Cabrera punched Plaintiff Rhodes in the eye and mouth, at which point he lost consciousness. Plaintiff Rhodes was then placed under arrest. Plaintiff Pantojas protested the brutal treatment of Officers Calzada and Cabrera and she too was subsequently placed under arrest. Because of his injuries Plaintiff Rhodes was taken to a hospital and treated but was released back to the NYPD after being treated. The criminal complaint ultimately produced by NYPD Officer Calzada included false statements about the incident and Plaintiff Rhodes was charged with resisting arrest and harassments. The criminal case against Plaintiff Rhodes was adjured in contemplation of dismissal.
