After being brought to the 83rd, precinct, Virgil was humiliatingly strip-searched and falsely charged with possession and sale of marijuana despite no narcotics being found on his person. Virgil was then detained for 2 days before being arraigned. Though the false charges were eventually dismissed after several court appearances, Virgil was humiliated, defamed in his community, and prevented from performing his ordinary business. Defendants left the scene, and Plaintiff, injured and in pain, went to Wykoff Heights Medical Center for treatment. At the Hospital, defendants appeared, and without probable cause, arrested Plaintiff and brought her to the 83rd Precinct. In excruciating pain, Plaintiff asked to be taken back to Wykoff\nHospital but defendants refused. EMS arrived and took Plaintiff to Woodhull Medical Center where she was treated, including being prescribed a neck brace and pain medication. Plaintiff was taken back to the 83rd Precinct, where the officers falsely informed employees of the Kings County DA’s Office they had observed Plaintiff commit various crimes and prepared false paperwork including an arrest report. The officers did not observe Plaintiff commit a crime. Plaintiff was taken to Central Booking. \nOn July 23, 2012, Plaintiff was arraigned in Kings County Criminal Court and released on her own recognizance after about 36 hours in custody. Upon release, Plaintiff still in pain, returned to Wykoff Hospital for further treatment.
