Upon using his phone to record the incident, Defendant Captain Ramos shoved Mr. Acosta and stated that he was placing Mr. Acosta under arrest. Upon this statement, Defendants John Doe 1-6, Lieutenant Schmidt, Officer Holguin, and Captain Ramos dragged Mr. Acosta into the street, repeatedly struck him, and restrained him to the extent his breathing was restricted. The defendants continued to apply pressure to Mr. Acosta's neck after he stated he could not breathe and applied tight handcuffs. Mr. Acosta was detained without being charged and, upon release, issued a summons which was then dismissed. \n\nPlaintiff Wanebo was \"singled out\" by NYPD Police Captain or Sergeant John Doe 1, and Officer Prince O’Connor then grabbed her. John Doe 1 then attempted to place Ms. Wanebo in a chokehold, causing injury to her shoulder, and then Officer O'Connor handcuffed her. She was then transported, detained unlawfully, and told that usage of her phone call would prolong her detention.
