Shortly after stopping, NYPD vehicles arrived on the street, including one NYPD vehicle which blocked in the plaintiff's vehicle. NYPD officers appeared to be clearing the sidewalk, however, no NYPD officer requested plaintiff move or leave his vehicle. Plaintiff proceeded to open his front driver's side door to ask his passenger to enter the vehicle. At that time defendant-NYPD Sergeant Phillip Orlando ordered officers present to arrest any person who remained on his sidewalk. Although neither the plaintiff nor his passenger were on the sidewalk, defendant-NYPD officers, including Officer Yefery Dalmonte, arrested the plaintiff. NYPD-Officer Dalmonte refused to allow plaintiff to close his driver's side door or remove the keys from the ignition. Plaintiff asked defendant-officers why he was being arrested. Defendant-Dalmonte replied in substance that the defendant was following orders. \n\nThe plaintiff was brought to the 70th Precinct and transferred to Central Booking. Subsequently, Defendant-Dalmonte provided false information to the Kings County District Attorney's Office to support charges being filed against the plaintiff. The plaintiff was charged with disorderly conduct and obstructing governmental administration. On August 26, 2017, the plaintiff was released from custody.
