While being handcuffed, Beggs peacefully explained his innocence. \nBeggs was then subject to strip search at the precinct, subjecting Beggs to humiliation and seizure of his properties. Beggs was detained for about 55 hours until he was released, but with some of the properties unreturned -including multiple iPhones. At around 6:00 AM, an NYPD SWAT team led by Defendant Duffy entered the property on a search warrant for a different resident. They approached all three plaintiffs separately with guns drawn and other weapons, forcibly grabbed them, handcuffed them so tightly their hands turned red, and arrested them without probable cause or a warrant.\n\nPlaintiffs were taken into police custody and subject to multiple strip and cavity searches. During their detention, defendant Officer Millwater swore out false criminal complaints against the plaintiffs charging each of them with violations of New York law, despite their being no probable cause for their arrest or charges. All charges were dismissed against each plaintiff on March 31, 2016. Plaintiff Almonte spent 27 days in police custody, and both Vega and Malave spent 70 days in police custody. Defendants Det. Duffy and PO Pagan approached plaintiff and asked plaintiff where he was coming from. Plaintiff said he coming from apartment 5E of 363 Wortman Avenue. Defendants took Plaintiff to an apartment on the first floor. A man opened the door of an apartment on the first floor and told defendants that he knew the plaintiff. Plaintiff was handcuffed, arrested and transported to the 81st Precinct in Brooklyn, NY. \nAt the precinct, defendant Duffy ordered Plaintiff to remove his shirt and questioned Plaintiff on the meaning of his tattoos. Plaintiff was told he had to slide under the bathroom door in order to use the bathroom. Defendant Duffy told plaintiff to pull down his pants and show plaintiff's testicles and butt, but Plaintiff refused to undress. Defendant Duffy forced plaintiff to pull plaintiff's pants down and display plaintiff's testicles, the area under plaintiff's penis, and plaintiff's anus for visual inspection. Plaintiff was released with a desk appearance ticket, about 5 hours after his arrest. About May 19, 2013, plaintiff was charged with criminal trespass in the second and third degree.
