When several NYPD officers in SWAT gear, including Defendant BOYSTAK, broke down the door to the bedroom where Plaintiff was sleeping.\nDefendants then put a gun to PLAINTIFF’s head, and then violently threw\nhim to the ground. Defendant BOYSTAK and the John/Jane DOE Officers unlawfully searched the area where PLAINTIFF was located. Defendants had no probable cause. Defendants placed PLAINTIFF's hands tightly behind his back and then forcefully pushed PLAINTIFF’s face into the floor.  Defendant officers then stepped onto PLAINTIFF’s head and neck, kicked and punched him several times about the body, and otherwise used excessive force.\n\nPLAINTIFF was subsequently transported to the police precinct where he was\nsearched, questioned, fingerprinted, photographed, and detained in a holding cell.\n At the precinct the Defendants including BOYSTAK and DOEs falsely informed the DA that they had observed PLAINTIFF commit various crimes/offenses. The allegations made by Defendants to the DA’s Office were false, and the Defendants knew that all the allegations were false.  The defendants sent these false allegations to the DA’s Office  to persuade them to commence and/or continue the criminal prosecution of PLAINTIFF.  From the precinct, PLAINTIFF was then transported to Central Booking, where he was detained for an extended period. PLAINTIFF was released after arraignment.
