He reached into the back seat to retrieve his cane when NYPD Officers Foy and John Doe 1, who told him that he had committed a moving violation. William told the officers that his girlfriend was the driver and she had gone to the grocery store a few minutes prior. Foy told the plaintiff that a kid was shot a few days prior by someone driving a rental vehicle and ordered the plaintiff to produce the vehicle's papers. However, plaintiff informed that plaintiff that his fiancée was the renter of the vehicle and had the papers. His fiancee returned with the papers, and John Doe 1 searched the vehicle without probable cause, finding a small quantity of marijuana. The officers then arrested the plaintiff without probable cause or legal justification. After being held for 3 hours at the Bronx Police Department, he was released with a desk appearance ticket. On August 30, 2013, he was arraigned for Criminal Possession of Marijuana in the Fifth and Second Degrees. All charges against him were favorably terminated.\nThen on July 1, 2014, when Ronald was leaving a house, he was approached by Officer Colon and John Doe 2, who ordered him to identify himself because someone dressed like him had committed robberies in the area. Plaintiff declined to produce his wallet because he was afraid that it was dark and would be mistaken for a gun, but he told the police his full name and that he was a disabled war veteran. The officers then arrested him without legal justification and brought him to a nearby store where the victim of a robbery pointed at him. Subsequently, when plaintiff was taken to the 28th Precinct, he complained that the handcuffs were too tight. In response, Colon said that he did not care and pulled the handcuffs upward causing plaintiff to fall forward and slam his face on the concrete floor. He was treated at Harlem Hospital Center for injuries sustained. He was arraigned on July 2, 2014 on charges of Petit Larceny, Criminal Possession of Stolen Property in the Fifth Degree, and Unlawful Possession of Marijuana.
