She selected certain items and brought them to the checkout counter, and presented them to the cashier. Several employees of the department store then physically detained Plaintiff despite knowing that Plaintiff had done nothing wrong. The store personnel brought Plaintiff to a room within the subject premises, where she was threatened, demeaned, screamed at, illegally searched, and abused for an extended period of time. Store personnel called the police, after which PO Jason Kleinman and John Does 1 through 5 arrived and arrested Plaintiff, without making any inquiry or investigation whatsoever, and without even ascertaining from anyone what the factual allegations were against Plaintiff. Later on, after Plaintiff was in custody, she was told by the POs that the NYPD had an agreement with the department store to the effect that if store personnel summoned NYPD to the store and directed the police officers to arrest a customer, NYPD would do so without asking any questions, etc. \n\nIt was only after Plaintiff had been arrested and placed in jail that store personnel provided information to PO Kleinman and John Does 1 through 5, alleging that Plaintiff had switched price tags on clothing; at that time, the POs knew that the allegations were false and fabricated and that there was never any legal basis to detain or arrest Plaintiff. The POs also knew that there was no legal basis to prosecute her. Nevertheless, PO Kleinman and the other POs conspired with the store personnel to have Plaintiff prosecuted for an offense they knew she had not committed. Plaintiff was imprisoned for approximately thirty-six hours. She was arraigned on or about February 5, 2013, based on the false accusations and evidence, and was released on her own recognizance.
