PO Henriquez, without cause or a warrant, stopped, struck, verbally abused, searched and detained Plaintiff without cause or justification. Plaintiff was visiting the Bronx to record music as an aspiring artist. At 7:20 p.m., Plaintiff was shocked by the sound of banging on the apartment door she had visited to record music. Defendant POs in helmets and combat gear, with guns drawn and pointed, broke down the apartment door and rushed towards Plaintiff. Filled with fear Plaintiff complied and collapsed to the floor where Defendants handcuffed her immediately. While on the ground Plaintiff asked why this was occurring and the Defendant POs responded that she was resisting arrest and going to jail for possession of drugs. Despite pleading that she was visiting and did not live there, POs arrested Plaintiff and took her to the 41st Precinct in the Bronx. Plaintiff was forced to stay in Bronx Central Bookings for a weekend. Without cause, the defendant NYPD officers lawfully stopped and searched Mr. Martinez. Plaintiff told the defendants that he had a hypodermic needle in his pocket that he had lawfully obtained from a licensed needle-exchange program. Plaintiff showed the defendants his membership card verifying his enrollment in the program. Pursuant to New York Penal Section 220.03, it is legal to possess a hypodermic needle, with or without residue, if it was lawfully obtained. Referring to plaintiff’s needle-exchange program membership card, one of the defendants stated, in sum and substance, “I don’t give a fuck about that” and threw the card on the ground. Plaintiff was then handcuffed, falsely arrested and taken to the 41st precinct. Bail was imposed, which plaintiff could not post, and he was taken to Rikers Island. After he had been held for approximately 8 days, all charges against plaintiff were dismissed and he was released.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.421091/gov.uscourts.nysd.421091.5.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/13056142/martinez-v-henriquez/"},{"name":"Martinez, Edwin vs City of New York, et al.","start_date":"2013-03-12","disposition_date":"2014-03-14","payout_amount":35000,"disposition":"Settlement","docket":"020768/2013E","court":"Supreme Court - Bronx","officer_name":"Henriquez, Homer O.","documents":[{"url":"https://www.documentcloud.org/documents/4922172-Martinez-v-City-of-New-York-et-al"},{"url":"https://www.documentcloud.org/documents/4922173-Martinez-v-City-of-New-York-et-al"}]}],"documents":[{"url":"https://www.documentcloud.org/documents/24441170-bronx-notified-officers-list-edited_redacted-redacted_redacted","type":"credibility-finding"}],"id":"S6F7","url":"https://www.50-a.org/officer/S6F7"}
