The officers, Michael Delwy, Mark Dumelle, and two additional officers, referred to as John Doe New York Police Officer Number One and Two, detained Libhart because they believed he had discarded a marijuana cigarette. None of the officers were in uniform and did not identify themselves before grabbing Libhart and macing him. The plaintiff was repeatedly punched by Officer Delwy and Officer Dumelle while laying handcuffed on the ground. During this time, none of the officers intervened in the assault. The plaintiff was taken to the 9th Precinct and charged with assault in the second degree against Officer Delwy.
