McKay, a camp counselor, was returning to his friend Emanuel’s apartment near Public School 199. He had stopped to chat with acquaintances near West 162nd Street and Ogden Avenue. At that moment, two black Crown Victoria sedans approached the area. Plainclothes NYPD officers, including Officer Robert Vassallo, exited and began questioning McKay. They asked if he possessed any contraband and searched the surroundings. Shortly after, Officer Vassallo handcuffed McKay and placed him under arrest without legal justification. McKay was then taken to the 44th Precinct, where he was strip-searched and detained in a holding cell. Around 11:00 p.m., officers transported him to central booking in Bronx County. He was held until his release on his own recognizance at 11:00 p.m. the following day. McKay’s case required multiple court appearances before its eventual dismissal on November 28, 2017. Due to the arrest, he lost his job, causing a significant loss of income.
