The defendants did not have any legal cause to handcuff or seize the plaintiff. Rather, at the previously mentioned date and time, the plaintiff was eating at a restaurant with his friend. The plaintiff's friend left his car double-parked outside. After seeing that a police car had pulled behind the friend's car, the plaintiff came outside the explain the situation to the officers and move the car in order to avoid receiving a ticket. One defendant asked the plaintiff for his license and the plaintiff complied. Shortly thereafter, the plaintiff's friend arrived outside and the two people, the plaintiff and his friend, got into the friend's vehicle. While in the car, the officers hit the friend's vehicle. The plaintiff opened the car door but pinched a nerve while exiting the vehicle, which caused him to fall to the ground. One of the officers informed the plaintiff that he would not get arrested if he could get up. However, since the plaintiff had pinched a nerve, he could not get up and called an ambulance. After calling the ambulance, Officer Rodriguez arrested the plaintiff for a suspended license even though the plaintiff never drove any vehicle. \n\nAfter unlawfully arresting the plaintiff, the defendants transported him to a local precinct in the Bronx where he was held for approximately 32 hours. The plaintiff suffered physical injuries as a result of this incident and the unlawful arrest that required him to be treated at Jacobi Medical Center.
