They then physically restrained the plaintiff, violently contorted the Plaintiff's arms behind their back, placed the Plaintiff's hands in metal handcuffs, and caused the Plaintiff substantial injuries and pain to the Plaintiff's back, neck, arms, hands, and wrists. Despite Plaintiff telling the Defendants that the handcuffs were too tight and causing pain, the Defendants ignored Plaintiff's request to loosen the handcuffs and instead decided to subject Plaintiff to illegal strip searches. The defendants' fabrication of the situation led the District Attorney's Office to charge the  Plaintiff with the Sale of a Controlled Substance in the Third Degree and the Plaintiff's detainment for 41 months until his release from prison on or about November 16th, 2017. Plaintiff's charges were terminated in his favor on October 9th, 2019. Ultimately, Plaintiff believes he was targeted because he is an African-American male. During the arrest of plaintiff, defendants committed excessive force against her, by maliciously, gratuitously, and unnecessarily pointing a firearm at her, grabbing plaintiff, and placing excessively tight handcuffs on plaintiff's wrists. Those defendants who did not touch plaintiff, witnessed these acts, but failed to intervene and protect plaintiff from this conduct.The individual defendant officers did not have an objective and/or reasonable basis to use any degree of force against plaintiff, since plaintiff was unarmed, compliant, and did not resist arrest. Plaintiff was physically injured as a result of the excessive use of force, and suffered numbness and marks to her wrists.
