(Henisha Toppin’s 10-year-old son), were subjected to false arrest, false imprisonment and detention, illegal taking of property, loss of parental rights, assault and battery and use of excessive force, for acts of which plaintiffs were innocent. On the incident date, Plaintiffs were having a New Year’s Eve celebration at Toppin’s mother’s home in Brooklyn. At approximately 3:00 a.m., Several police officers arrived at the location and knocked on the door.  When no one inside answered the door, police officers remained on scene and refused to leave. At approximately 5:00 a.m., the all three plaintiffs exited the location and were arrested and taken to the 69th Precinct without probable cause.\n\nWhile in police custody, Plaintiff Jones was forced to stand outside in the extreme cold wearing only boxer shorts on her lower extremities and wasn’t provided pants for several hours after arriving at the police station. During the arrest, Police officers took Toppin and Jones’s cell phones and never returned them (illegal taking of property/conversion). Plaintiff Jones was held in police custody for approximately 48 hours and was never charged with a crime. Plaintiff  Toppin was subject to a humiliating search at the police station in front of her 10-year old son and was held in custody for over 24 hours. J.T. was released to his grandmother and was never charged with a crime. Toppin was eventually charged with Criminal Possession of a Weapon. The Kings County DA’s Office later dismissed all of the charges against her. As a result of the unlawful arrest, Toppin was required to attend family court hearings concerning her custody of J.T. Toppin lost custody of her son J.T. and J.T. lost his right to live with his mother for an entire year (loss of parental rights). J.T. suffers from nightmares because of the actions of the defendant police officers that caused him to be separated from his mother. Plaintiffs were also subjected to assault and battery and excessive force by the NYPD officers, although these actions of the NYPD officers and the extent of any physical injuries are not described in greater detail in the complaint.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nyed.508155/gov.uscourts.nyed.508155.1.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/68126534/toppin-v-city-of-new-york/"},{"name":"Vesprey, Andrew vs City of Ny, et al.","start_date":"2022-09-09","disposition_date":"2024-06-17","payout_amount":18500,"disposition":"Settlement","docket":"514330/2022","court":"Supreme Court - Kings","summary":"On February 22, 2021, plaintiff, an African-American male, was within the 69th Precinct, 9720 Foster Ave, Brooklyn, NY, attempting to file a complaint against a third-party. The third-party, present at the precinct, falsely alleged plaintiff of harassment. Defendant-officers, including Daniel Catalano and Christopher Scaperotta, refused to engage with plaintiff. Without probable cause, reasonable suspicion, or valid arrest, defendant-officers violently contorted plaintiff's arms, applied tight metal handcuffs, and ignored plaintiff's requests to loosen the handcuffs. Defendant-officers then proceeded to conduct, or failed to intervene in co-defendant's conduction of, an illegal search of Plaintiff in view of bystanders.\n\nDefendants detained plaintiff in a dirty cell for 7 hours. Defendants then transported plaintiff to Central Booking for 15 hours. Defendants knowingly and intentionally fabricated false and fictious evidence, observations, and occurrences to substantiate false charges against plaintiff; false allegations incorporated into a criminal court complaint signed by the defendants. On March 15, 2021, the criminal proceeding was dismissed by the King's County District Attorney's Office.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=YWd_PLUS__PLUS_JHgyUVJ456iMtvCBg==","type":"complaint"}]}],"payroll":{"salary":"109352","regular":"108510","overtime":"94","other":"25817","total":"134422"},"id":"SA3F","url":"https://www.50-a.org/officer/SA3F"}
