Plaintiff did not commit a crime or violate the law, or behave in a manner that would lead a reasonable police officer to believe that Plaintiff committed, or was about to commit a crime or violation of law. At no time did the Defendant police officers recover any drugs, weapons or any other contraband from Plaintiff's person or Plaintiff's possession, custody or control. Plaintiff was unlawfully handcuffed and falsely arrested by Defendant officers and transported to the Precinct where he was placed in a holding cell. Plaintiff was transported to Central Booking. The Defendant police officers provided the District Attorney with misleading and incomplete information alleging that Plaintiff violated the New York City Administrative Code. A prosecution was initiated against Plaintiff for violating the Administrative Code - Unreasonable Noise from a Vehicle Horn. Plaintiff was released from custody after approximately 24 hours. On June 2, 2017, all charges against Plaintiff were dismissed and sealed. As a result of the false imprisonment and arrest, Plaintiff lost his job at Empire Merchants warehouse, from which his income was approximately $500 per week.
