Johnson opened the apartment door and was immediately arrested.  The parole officers then entered the apartment and allegedly saw on the counter near plaintiff a bag containing crack cocaine.  The parole officers called the NYPD, and defendant Detective Tamara Williams and other unidentified officers arrived at the apartment.  Plaintiff was charged with Criminal Possession of a Controlled Substance in the Third Degree (possession with intent to sell) and Criminal Possession of a Controlled Substance in the Fifth Degree (possession of over 500 mgs of cocaine).  Defendants withheld from the prosecutor that the bag was not clear, and thus they had no probable cause to search the bag. The parole officers then entered the apartment, discovering plaintiff and his co-defendant Shavaler Johnson next to a bag allegedly containing 26 twists of crack cocaine, and then summoned assistance from the NYPD including defendant Detective Tamara Williams. The bag was neither photographed nor preserved, and plaintiff and his co-defendants were charged with criminal possession with intent to sell. Plaintiff alleges that there was significant evidence the bag was not in plain site and any search of the bag revealing its content was illegal, given testimony from officers at the trial that the contents of the bag could not be ascertained without opening it. Plaintiff was incarcerated for twenty two months awaiting trial before being convicted, but his conviction was reversed and he was acquitted of all charges on retrial on April 26, 2019, although only after his lengthy incarceration. Per plaintiff, the false testimony from the parole officers and NYPD defendants including Detective Williams influenced the decision of the prosecutors to continue the prosecution.
