On April 12, 2014, Plaintiff was arrested and charged with possession of a controlled substance.  He was arraigned and released on his own recognizance on April 14, which he reported to his parole officer that day.\n\nOn June 16, 2014, during a scheduled visit, Defendant Parole Officer Dana Newton arrested Mr. Moore for violating parole, and he was transported to Rikers Island.  At a formal hearing on July 9, the ALJ preliminarily confirmed that Plaintiff had completed his sentence and was due for release on July 31, but would have a final hearing on July 23.  On July 23, Defendant Parole Officer Garfield Bolton was not prepared to proceed and stated that he had been instructed by his supervisor, Defendant Parole Supervisor Edward Delrio, to close the case by July 31.  That paperwork was submitted to the Board of Parole on July 25 but not acted upon.  Plaintiff was illegally held in jail past July 31, after which Plaintiff, his father and his public defender repeatedly contacted the various parole officers, Board of Parole and other public officials, but the various Defendants and public officials failed to take action.  Finally on September 5, Plaintiff’s case was called in court when his public defender happened to be present, at which point the ALJ ordered his immediate release.  Plaintiff was released on September 9 after 39 days of illegal detention.
