Plaintiff, while in a separate room from these three individuals, heard a gunshot. When Plaintiff entered the room, he saw that one of the females had been shot in the leg accidentally by J.C. J.C. then hid the gun and fled the scene. Plaintiff called 911 to assist with the gunshot victim’s wound, and Detective Shalimar Scribner along with NYPD Does #1-5 arrived in response to the call. The two females indicated that J.C. was the victim’s boyfriend, and that he had possessed and discharged the weapon. The bag in which the gun was recovered contained J.C.’s identification and personal effects. \n\nFollowing the initial statements, the victim changed her story to implicate Plaintiff rather than J.C. Detective Scriber and NYPD Does #1-5 had good reason to doubt this story, due to J.C.’s relationship to the victim and the weight of evidence otherwise. Instead of tracking down J.C., the Defendants falsely accused Plaintiff of the crime. Plaintiff was arrested and detained in an aggressive manner, causing pain and swelling in both of Plaintiff’s wrists. Defendants knowingly provided this false information for the malicious prosecution of Plaintiff. Defendants fabricated evidence and omitted information beneficial to Plaintiff. Plaintiff was prosecuted by the Kings County District Attorney’s Office, and subsequently incarcerated for five days where he suffered damages to his physical and mental health. The plaintiff noticed an NYPD vehicle pull up beside the vehicle on the driver's side, and three uniformed officers exited the vehicle, approached the plaintiff, opened her door, and pulled her from the vehicle. The defendants asked if she knew she was sitting in a stolen vehicle, to which she replied that she did not think it was stolen. The defendants then arrested her, restrained her with metal handcuffs, and subjected her to an unlawful pat-down search. After the arrest, the plaintiff was taken to the 73rd precinct, where she was unlawfully fingerprinted, photographed, searched, and placed in a holding cell. The defendants interrogated her about her knowledge of the vehicle, which she stated her friend had purchased from a police auction. On April 30, 2020, the plaintiff was transported to Kings County Central Booking, where she was informed for the first time that she was being charged with possession of a firearm and placed in a holding cell. The car in which the plaintiff was arrested legally belonged to her friend. The defendants fabricated evidence and accused the plaintiff of criminal possession of a weapon. On May 1, 2020, the plaintiff was released on her recognizance after approximately 32 hours in custody. All charges were dismissed in favor of the plaintiff on February 8, 2021. He was then struck by a taser and arrested with handcuffs applied too tightly. He then began to bleed but was not immediately brought to a hospital. Hours later, Mr. Blocker was brought to the hospital where he remained in handcuffs and shackles. At the precinct, Mr. Blocker was informed he was arrested because he was parked in front of a school where he tossed a gun, which was a false statement. He was released without charges and was returned to his finacee's vehicle, where the car was then seized.
