Minutes later, four members of the NYPD, including Defendants arrived at Plaintiff's hotel room. Plaintiff was contained in his room, and interviewed by Defendants while assaulter Watkins was taken out and interviewed in the hallway and her hotel room. Defendant Pitt arrived and eventually ordered Rigsang to arrest Plaintiff. Plaintiff was handcuffed and arrested. Pitt instructed Rigsang to interview Watkins to obtain probable cause for plaintiff's arrest. Rigsang interviewed Watkins and within minutes determined there was no probable cause for arrest. Rigsang communicated to Pitt there was no probable cause for arrest. Pitt instructed Barcenas to take Plaintiff out and be transported to a Precinct for processing. Pitt instructed Rigsang to continue the process as if probable cause had been obtained. Plaintiff was taken from the hotel in handcuffs, and transported to the 1st Precinct. Plaintiff was locked in an unheated cage. Rigsang appeared in the cell and Plaintiff complained of the cold and his medical condition but Rigsang did nothing to address those conditions. Plaintiff refused photographs and fingerprints. Dunigan had Plaintiff involuntarily taken to a hospital for psychological evaluation. Plaintiff was held by Defendants without food, water and medication for twenty-seven hours. On December 12th, 2022, Rigsang signed a criminal complaint, fabricating probable cause. That day, Plaintiff was arraigned on multiple charges.
