Plaintiff was not affiliated with any gangs, and police investigating the shooting were aware Plaintiff was not affiliated with any gangs. Police showed a photo array to an unreliable eye witness, who selected Plaintiff's photograph as the perpetrator. This identification constituted the sole item of evidence police had against Plaintiff, and contravened all other evidence that demonstrated Plaintiff was not the perpetrator. Despite this, Det. John Doe signed a false criminal court complaint charging Plaintiff, in part, with attempted murder and withheld information that the eyewitness was unreliable from prosecutors. \n\nPlaintiff's bail was set high due to police misrepresentations and Plaintiff remained incarcerated at Rikers Island pending trial. At trial multiple witnesses testified in Plaintiff's defense. Regardless, a grand jury indicted Plaintiff of, in part, attempted murder based solely on the unreliable photo identification. An unrelated ATF investigation identified exculpatory evidence. Prosecutors purposefully withheld this information from Plaintiff, and after months of surviving at Rikers, unaware of the exculpatory evidence, Plaintiff reluctantly accepted a plea deal and served his time.
