The shooting occurred at 5 AM following a party after an argument between the shooting victim and an individual later identified as possibly a gang member over a taxi cab.  Detectives Geary and Bencosme and other NYPD defendants manufactured a story about an unidentified witness who stated during a canvass that the shooting had been done by someone named Marcus whose last name she thought was \"King\".  The detectives/officers created evidence to document this phony canvass and spread word in the neighborhood that they had identified the suspect in the shooting.  They spoon fed statements to witnesses to implicate plaintiff and failed to conduct a lawful identification process.  At no time did any officer intervene to prevent the framing of plaintiff.   All this time, plaintiff had had nothing to do with the shooting, had been nowhere near the party or the shooting, despite the framing by detectives.  The court found that the single photo ID was improper and unconstitutionally suggestive, but allowed in court ID of the plaintiff as a matter for juror credibility determination.  At the first trial, plaintiff was acquitted on the most serious charges (including attempted murder)  and a mistrial was declared on other lesser charges.  The DA's office offered a term which would have resulted in his immediate release if he pleaded guilty to the lesser charges, which he declined, preferring to clear his name.\nAt his second trial, firearms id confirmed that the gun entered into evidence was the gun used in the shooting, but the only evidence \"linking\" him was a DNA test which contained multiple errors and which was improper to use because of the low quantity and quality of sample material.
