Defendant NYPD Officers Mark Fleming and Redmond Murphy attended his bedroom responding to a wellness check requested by his landlord. The bedroom door was locked and needed to be broken in. When Fleming and Murphy entered the bedroom, the Plaintiff was standing silent and motionless with his hands at his sides in the far corner with a bed position between him and the officers. The lights were off. Fleming and Murphy told the Plaintiff to put down what they thought was a knife. They shouted commands at him while pointing their guns and him and shining flashlights in his eyes. The shouting persisted for seven (7) minutes with the landlord joining in. The Plaintiff never moved. A taser unit was called in after approximately 13 minutes. By the time the taser unit arrived, which included Jesus Ramos and Marcos Oliveros, Fleming and Murphy alleged that the Plaintiff also had a gun. The Plaintiff had still not moved or acknowledged the presence of the officers or landlord. The shouting commands became increasingly profane and frantic. At approximately 15 minutes into the encounter, Ramos was instructed to \"hit him\" with the taser. The Plaintiff had still not moved or said anything. The taser barbs shot by Ramos hit the Plaintiff in the chest and groin but did not pierce his skin. Immediately after Ramos fired his taser, both Fleming and Murphy opened fire on the Plaintiff with their semiautomatic handguns. A total of 16 shots were fired at the Plaintiff by Fleming and Murphy, with seven (7) striking the Plaintiff in the front of his body. The Plaintiff died of the gunshot wounds.
