Officer Fadugba called Officer Kenny Tucker to come to the scene to arrest Plaintiff for driving while intoxicated. Plaintiff maintained he did not consume any alcoholic beverages. Plaintiff was arrested and taken to the Intoxicated Driver Testing Unit and took a breathalyzer exam, without receiving proper refusal warnings. However, the officers later alleged Plaintiff refused to take the test. Plaintiff was held in custody for approximately 24 hours.  Officers Fadugba and Tucker manufactured false, unreliable and/or misleading evidence for prosecution, and the DA's office withheld exculpatory evidence and failed to call a witness.  \n\nWhile the criminal matter was pending, Officer Fadugba, the only officer who supposedly observed Plaintiff operating a vehicle while intoxicated, had been deployed overseas. The DA refused to dismiss the case. Plaintiff's case went on for more than 3.5 years, requiring approximately 25 court dates. On each court date, Plaintiff had to take a day off from work, resulting in over $17,000 in lost wages. Officers Kenny Tucker and Rios threw Plaintiff against a car and illegally searched him.  Finding only a wallet and phone, Officer Tucker called his station.  In conversation with Officer Rios, Plaintiff was told he was detained because he had dropped the paper plate from his pizza.  Officer Tucker returned and announced there were two open warrants against Plaintiff and handcuffed him without any resistance.  When Plaintiff asked if his friend could take $300 from his wallet that was for his work, rather than have it taken to the station, Officer Tucker sprayed mace into the defenseless Plaintiff’s face, causing immediate and severe pain.  Plaintiff was then transported to the 69th Precinct and put in a cell for 45 minutes.  Officer Rios entered the cell and offered Plaintiff a deal – accept tickets for littering and disorderly conduct and the officers would not press more serious charges.  No warrants existing and the officers made false statements about their existence.  Plaintiff accepted, was ticketed, released, and then went to the hospital for treatment.
