Officer Conway physically searched Mr. Lynch and found a pair of dice in his pocket – they put the dice back in his pocket, ran his name through a computer, and informed Mr. Lynch that his name was ‘clean.’ Mr. Lynch asked Officer Conway if he was free to leave – Officer Conway said no and that everyone at the barbeque had to be searched. Officer John Doe then ran Mr. Lynch’s name through the computer again – it came up clean again. Officers Conway and John Doe began to speak with each other and Mr. Lynch heard Officer John Doe ask about the dice. Officer John Doe then searched Mr. Lynch and then proceeded to handcuff him for gambling. Mr. Lynch was placed into an unmarked van – in the process, Officers John Doe and John Doe #1 intentionally caused Mr. Lynch’s nose to strike the right door of the van, causing a laceration to the bridge of his nose. Mr. Lynch was then taken to a local precinct and subject to a third search by the Officers. Mr. Lynch was then held for about 24 hours in custody before he was charged by Officer Conway with loitering and remaining in a public place for the purposes of gambling.
