Plaintiff settled a dispute regarding payment with the restaurant owners. Immediately thereafter, defendant-NYPD officers, including Officers James Biondo and Bendito, entered the restaurant. Defendant-officers insisted on making an arrest. Pursuing this, defendants forcible restrained plaintiff, wrestled his arms behind his back, and tightly handcuffed plaintiff. Plaintiff did not resist arrest. Plaintiff repeatedly requested medical attention due to the tight nature of the handcuffs. Defendants ignored these requests. Instead, defendants transported plaintiff to the 45th Precinct. Plaintiff was held in custody for approximately 12 hours.
