The officers entered with shields, body armor, and guns drawn, claiming to have a search warrant. The officers recovered Oxycodone bottles in prescriptions bottles with Plaintiff’s name on them and put them into a plastic bag to make it look like Plaintiff possessed them illegally and intended to sell them. The officers also recovered $31,000 in cash in a safe. Plaintiff tried to explain that he was prescribed the Oxycodone and that the money was obtained from a deceased family member. Plaintiff was thrown to the ground, handcuffed, and arrested. Plaintiff was charged with felony gun possession and conspiracy counts. Publicity was given to Plaintiff’s false arrest; he and his wife were painted as major drug dealers in a local newspaper. Plaintiff spent approximately 5.5 months in jail until he was able to make bail in May of 2015.
