At approximately 11:00 a.m., two NYPD members arrived at the plaintiff's residence, placed her in handcuffs and arrested her without explanation. The officers took her to the 77th Precinct where she was told that her landlord told 911 that the plaintiff threatened to have her boyfriend shoot him. The plaintiff didn't have a boyfriend and never made any such comment to the landlord. She explained that he was making a false complaint because she had called 311 that day, and his history of false complaints. Nevertheless, she remained detained for approximately 6 hours. \n\nDuring the plaintiff's time in custody, Sgt. Cascone mocked and harassed her when she asked to go home. She was deprived of food, water, and a phone call. Her access to the bathroom was unreasonably delayed. Detective Duffy eventually issued her a Desk Appearance Ticket and released her from custody.
