Plaintiff complied with the orders who then took Plaintiff's ID back to the car, went to their vehicle, then returned to Plaintiff and demanded he and the two aforesaid individuals exit the vehicle, and then proceeded to conduct an illegal search of Plaintiff's vehicle. Defendants then falsely communicated to Plaintiff that he had a warrant out for his arrest, but Plaintiff was completely unaware of said warrant. Defendants then found contraband in Plaintiff’s vehicle between the passenger seat and door that Plaintiff neither actually nor constructively possessed. Defendants accused Plaintiff of a criminal offense and seized him, and defendants proceeded to violently contort Plaintiff's arms behind his back so that they could apply metal handcuffs disregarding Plaintiff s complaints that the cuffs were placed on too tightly causing him significant discomfort and pain. Then defendants proceeded to conduct an illegal search of Plaintiff. Defendants then transported Plaintiff to the 40th Precinct and then to Central Booking before being brought back to the 40th Precinct where he was illegally detained in a dank and dirty cell for approximately eleven (11) hours, after which he was transported to EMTC on Rikers Island where Plaintiff was illegally detained for approximately six (6) days, and forced to deal with the attendant hazards and indignities of incarceration with general population on Rikers Island, including additional strip searches, being sprayed with chemical agents, being denied medical attention multiple times, and the unsanitary and grimy conditions of EMTC.
