Plaintiff, who lives in the first-floor apartment, was woken up by loud banging. Plaintiff opened the door to his apartment to find out what was going on. Peering into the hallway, plaintiff found two of the defendant P.O.s had gained entry into the common area and were pointing guns at him. Defendant P.O.s asked plaintiff if he was \"Sherwin,\" to which plaintiff responded in the negative. One P.O. proceeded to violently hit plaintiff with a shield. Plaintiff was then grabbed, violently slammed to the floor, and punched in the face. Notwithstanding indications from plaintiff's girlfriend that he was not \"Sherwin\" plaintiff was left within the squad car. Moreover, defendant P.O.s subsequently spent three hours succesfully extricating the person who had locked himself in the 2nd-floor apartment. Defendant P.O.s achieved this without any violent, and yet plaintiff who had no connection to the barricade was still transported to the precinct and placed in a cell. Upon release from custody, plaintiff was issued with a summons for disorderly conduct.
