Officer Michael Corvi interrogated Plaintiff two times, during which Plaintiff was never read his Miranda Rights and never waived them. Officer Corvi falsely claimed that Plaintiff admitted to knowing that the container contained drugs and admitted to knowingly transporting drugs when Plaintiff never did so in the two interrogations. Plaintiff was charged with Conspiracy to Distribute Cocaine and Attempted Possession of Cocaine with Intent to Distribute based on Officer Corvi's false claims. During the criminal trial, Officer Corvi falsely testified that Plaintiff was read his Miranda rights, that Plaintiff waived his Miranda rights, that Plaintiff implicitly knew the container contained drugs, and that Plaintiff previously picked up other containers which he knew contained drugs. Plaintiff was convicted of Attempted Possession of Cocaine, and was sentenced to 42 months of incarceration followed by two years of supervised release. After Plaintiff appealed, the 2nd Circuit vacated Plaintiff's judgment conviction on October 1, 2020.
