Knaust attempted to break up the fight and Defendant P.O. Erik Contreras of the NYPD ran over to subdue Prioleau. P.O. Contreras fought with and assaulted Defendant Prioleau and restrained him. P.O. Contreras called 911 and reported that Prioleau had assaulted a civilian and assaulted Contreras in the process of being restrained. Defendant Nassau County P.O.s Allison Beyerlein, William McEnroe, Brian Murphy, and Terrence Quinn arrived on the scene to conduct an investigation based on Contreras's statements. Defendant Nassau County P.O.s failed to review security camera footage of the scene or adequately investigate Plaintiffs' claims of innocence.\n\nLater that day, Contreras reported the assault to the Nassau County Police Department and implicated Knaust and Iuzzolino as the perpetrators, in contravention of what he had told the 911 dispatcher. Knaust and Iuzzolino were arrested and charged with felony assault. On Nov. 2, 2012, Iuzzolino and Knaust were arraigned and released. These charges were reduced to misdemeanor assaults and dismissed on March 3, 2014. Plaintiffs were taken to the 102nd Precinct and held in various filthy cells thereafter in Central Booking and Riker's Island, subjected to crowded, unsanitary, and unsafe conditions including, inter alia, clogged or unavailable toilets and lack of heat, bedding, and medical attention. Plaintiffs were sick and vomiting throughout and frequently requested medical attention, which was only provided in the afternoon of January 15, 2013. On January 15, 2013 all charges were dismissed and on January 16, 2013 at approximately 8:00 a.m. Plaintiffs were released after approximately 83 hours in wrongful incarceration. Mr. Mormone told the officers that he lived there and asked what they were doing. The officers ignored him, and so Mr. Mormone asked them to leave. The officers again ignored him, and then moved towards him in a threatening manner. Mr. Mormone entered his home and asked his aunt if she knew why the officers were there. The officers followed Mr. Mormone and tried to enter the residence, despite neither Mr. Mormone nor his aunt consenting. The officers threw Mr. Mormone to the ground and beat him; they slammed his head on the ground, stomped him and dragged him to the police car. The officers then intentionally closed the police car door on Mr. Mormone's legs. Mr. Mormone was then taken to the police precinct.\n\nAt the precinct, the police officers falsely informed the Queens County District Attorney's Office that they had observed Mr. Mormone commit obstruction of governmental administration and resisting arrest. He was transported to central booking and then arraigned. He was released after approimately 24 hours in custody.
