Defendant NYPD POs, including PO Ryan V. Barba then approached Plaintiffs with guns drawn and ordered them to exit the vehicle. The officers then violently contorted Plaintiffs' arms behind their backs and applied handcuffs in an excessively tight fashion despite Plaintiffs' complaints that they were causing significant discomfort and pain. The officers subsequently conducted an illegal search of Plaintiffs, but recovered no contraband. Plaintiffs were arrested and placed in a cell for numerous hours whilst the officers maliciously fabricated evidence against Plaintiffs, causing them to be prosecuted. Plaintiffs had gathered with a small group outside an apartment when they were subjected to racial profiling by the defendants, pulled out of their chairs, turned against the fence, subjected to unlawful pat-down searches and tightly restrained with metal handcuffs.  Plaintiffs were embarrassed and humiliated in front of close family and friends.  Plaintiff Clarke was arrested so roughly by defendant officers that his phone fell out of his pocket, causing severe cracking and damage.  Thereafter, plaintiffs were transported to the precinct, where they were fingerprinted, photographed and placed in a holding cell.  The following day, they were transferred to Central Booking.  While Plaintiffs were in custody, the defendant police officers provided the Kings County District Attorney’s Office with the false information that Plaintiffs committed a crime.  Specifically, the defendant police officers falsely stated to the Kings County District Attorney’s Office that Plaintiffs were engaged in Criminal Possession of a Weapon, and other related charges. After accusing the Plaintiff of a criminal offense they asked him to step out of the vehicle and violently applied tight handcuffs. Thereafter, they conducted an illegal search of his person and vehicle before removing both to the 67th Precinct. \n\nAt the Precinct, the Plaintiff informed all of the Officers he had recently injured his knee and they forced him to strip his pants off to prove the injury. He was then transported to Central Booking where cavity inspections occurred and he was unlawfully detained for up to two days until release after arraignment. \n\nOfficer Barba fabricated allegations initiating malicious prosecution against the Plaintiff. While he was inside his vehicle, defendant officers approached the plaintiff and began interrogating him. Then they forcibly grabbed him, tightly handcuffed him, and began to illegally search the plaintiff and his vehicle, damaging the vehicle in the process. No contraband was found. The defendants transported the plaintiff to the precinct and subjected plaintiff to another unlawful search. The false changes were eventually dismissed and sealed on September 15, 2020. \n\nOn October 18, 2021, plaintiff was driving to his children's school to pick them up. As he made a left turn at an intersection, a second group of officers turned on their sirens and pulled him over. They ultimately directed plaintiff to step outside, opened plaintiff's door, forcibly grabbed the plaintiff and pulled him out of his vehicle. They then tightly handcuffed plaintiff and transported him to the precinct, where they subjected him to an illegal search. No contraband was yielded. The officers then searched the vehicle without any success. They further assaulted the plaintiff by forcibly pushing him into the cell, as a result of which, plaintiff became sick and requested to be sent to the hospital, but this request was denied until plaintiff's condition worsened. \n\nThe second group of defendants provided false charges, records, and statements.
