The officers did not recover any contraband from Plaintiff's person. While Plaintiff was being detained, officer Wren allegedly found a pistol on the rear passenger side wheel well of the minivan, and the officers placed Plaintiff under arrest. Plaintiff was unlawfully incarcerated on Rikers Island. \n\nOfficers falsely informed the DA office that they observed Plaintiff place a shiny object on top of the wheel well. Then, they falsely testified before a Grand Jury that they observed Plaintiff reach into his pocket, take out a shiny object, crouch down behind the minivan and continue walking. On April 28, 2019, the Grand Jury voted to indict Plaintiff on charge of Criminal Possession of a Weapon and other charges. On January 28, 2019, prosecutors at the DA office viewed a video surveillance tape which did not bear out officers' false claim that they observed Plaintiff in possession of a shiny object and place it on top of the wheel well of his minivan.
