Mr. Peralta began heading away from the argument and then saw two additional men running toward the group, at which point Mr. Peralta began running home. The two men were defendant NYPD Officers Andrew Distelhurst and Michael Gonzalez; they were dressed in plain clothes and never identified themselves as police officers or ordered Mr. Peralta to stop. The two men chased Mr. Peralta into his building. They forced the building's door open, and when he raised his hands in surrender, they turned him onto his stomach and lay down on him. While he was face down, one of the defendants kicked him in the face, and one hit him in the face twice with their hands. One defendant officer then left the building, and the other threw him down the stairs at the entrance to his building. Mr. Peralta's head head struck the pavement at the bottom. Throughout this time, the defendants failed to identify themselves as police officers. Both defendants Distelhurst and Gonzalez were wearing body cameras during the arrest, but the FOIL productions later made by the NYPD and the Bronx D.A.'s office was missing the video footage of the arrest inside Mr. Peralta's building.\nMr. Peralta was arrested and brought to a police precinct and later to central booking. The arrest report charged him with obstruction, resisting arrest, and disorderly conduct, based on false allegations, including that Mr. Peralta flailed around to avoid being handcuffed. At the precinct, he requested medical attention for his injuries, but he was not brought to the hospital until approximately seven hours after his arrest. He was brought to the hospital in leg restraints and kept handcuffed to a chair the whole time he was at the hospital. He was arraigned and charged with resisting arrest and obstructing governmental administration. He pleaded not guilty and was released on his own recognizance in the evening of May 2, having spent approximately 36 hours in custody following his arrest.
