On said date and time, Defendants appeared in the vicinity of this first complained-of-incident with a complaining witness (“Basement Neighbor”) who allegedly lived in the basement of Plaintiff’s apartment building and who lied about Plaintiff committing larceny. Defendants then falsely accused Plaintiff of a criminal offense of larceny, and in response Plaintiff proffered exculpatory information, including that Basement Neighbor and\nPlaintiff had issues in the past, that she did not steal anything from Basement Neighbor and that Basement Neighbor had attempted to steal from Plaintiff on prior occasions, that other residents could corroborate her statements, but said defendants ignored Plaintiff. Defendants aggressively grabbed her head and body before unlawfully searching her. Defendants then grabbed Plaintiff before violently contorting her arms and wrists behind her back and applying excessively tightened metal handcuffs. Defendants, including JOHN or JANE DOE 1-10, then placed Plaintiff in a police vehicle and transported them against their will to the 77th NYPD Precinct where Plaintiff was fingerprinted, photographed, searched or strip-searched and questioned.\n\nOn December 16, 2020, Plaintiff, Ms. Steele was in obeyance of all laws when she was caused to be unlawfully stopped, detained, battered and assaulted, seized and searched, and falsely arrested by or at the direction of Defendants, including GEORGE DAY and JOHN or JANE DOE 1-10 in the vicinity of 947 Saint Marks Avenue, County of Kings, City and State of New York. On said date but just prior to said time, Plaintiff was caused to be physically battered and assaulted by the aforementioned Basement Neighbor, and thereafter, Plaintiff called 911 as a complaining victim to criminal assault. Plaintiff was lawfully present as a complaining victim in the vicinity of this second complained-of-incident. Defendants, including DAY and JOHN or JANE DOE 1-10, then appeared in the vicinity of this second complained-of-incident and illegally approached Plaintiff. Plaintiff then complained to Defendants that she was a victim to assault by the aforementioned Basement Neighbor who broke into her apartment earlier that day, and in response, Basement Neighbor falsely reported to said defendants that he was assaulted by Plaintiff in her apartment where he also lived. Plaintiff then proffered exculpatory information to Defendants, including the lease to her apartment showing her as the owner of the premises, a short form order in Plaintiff’s favor from a previous housing case against Basement neighbor, that there witnesses readily available who would corroborate Plaintiff’s story, that Plaintiff was the original party who phoned the police because she was assaulted but said defendants ignored or outright refused to listen to Plaintiff and falsely stated that Plaintiff had an outstanding warrant when she did not. Defendants, including DAY and JOHN or JANE DOE 1-10, then falsely accused Plaintiff of a criminal offense and arrested her.
