Several Defendant Officers stopped and detained Plaintiff without probable cause. Defendants unlawfully handcuffed Plaintiff in the absence of probable cause and refused to tell Plaintiff why he was being arrested. Defendants searched plaintiff without consent, and nothing illegal was found on his person. Plaintiff was unlawfully taken in handcuffs to the 48th precinct. At the precinct, Plaintiff was fingerprinted, photographed and place in a holding cell. While Plaintiff was in custody, the defendant officers provided the Bronx County DA with false information that Plaintiff committed a crime and possessed a firearm. Plaintiff remained in the holding cell for several hours before being taken to Central Booking. Plaintiff was searched again, photographed, and retinal scanned before seeing a Judge for arraignment. The Judge set bail at $10,000. Plaintiff was unable to make bail and was taken to Rikers Island. After 5 days in custody, the Bronx County DA did not indict Plaintiff, and Plaintiff was released.
