A police offices invitiguated, and disregard the neighbor's alegation as false.\n\nPlaintiff reported to the Administration for Children Services that her neighbor abused verbally and physically the neighbor's six children.Plaintiff notified the two ACS workers who were outside the building at this time, that \"Gordo\" was not permitted in the building because of an Order of Protection that was in place against him, and that he had just escaped by going down the building's fire escape.\n\nAt approximately 10:00-10:30 p.m, Plaintiff called 911 from her apartment at 3094 Villa Avenue, Bronx, New York, to report that a man named “Gordo” and her neighbor Braila Baptiste were attempting to break down her door and threatening to kill her. At the same time, the Neighbor calle dthe police to falsely report that Plaintiff had attacked her and her daugther with a knife.\n\nShortly afterward, Police Officer Ortiz and Officer John Doe from the 52nd Precinct arrived at the scene. Despite Plaintiff being the complainant, Officer Ortiz immediately arrested her without probable cause, stating, “We have been here before, put your hands behind your back.”  Ortiz did not allow her to inform her daughter or elderly domestic partner of her arrest before removing her from the apartment. \n\nPlaintiff was taken to the 52nd Precinct, where she was held for approximately 3-4 hours before being transferred to Central Booking. On  July 20, 2018, at 3:00 A.M., in the Precint, Plaintiff knew that she was arrested and charged with menacing the neighbor and neigbor's daugther with a knife.\n\nNotwithstanding that Plaintiff told various Defendant Correction Officers, including Defendant Correction Officer JOHN DOE No. 1, at Central Booking that she suffered from seizures and required her seizure medication, no Defendant Correction Officer, including Defendant Correction Officer JOHN DOE No. 1, granted her request, cmising Plaintiff to suffer a seizure at Central Booking, which could have been avoided if she had been given her seizure medication.After she suffered the seizure, Plaintiff was provided by Defendant Correction Officers, whom she does not know their identities, with some kind of seizure medication, but not her own prescription for same.\n\nAfter approximately 18 hours in custody, Plaintiff was arraigned and released on her own recognizance on July 20, 2017, around 3:00 p.m. \nWhen she came back to her house, the neighbor called 911 to report that Plaintiff had returned so that she could be arrested again as a resulto of an order of protection that the neighbor obtained against Plaintiff.
