One of them came up to plaintiff, and without probable cause, placed excessively tight handcuffs on him and brought him to the ground, causing him physical injury. While plaintiff was handcuffed, the officers searched him, and did not find any contraband or buy money. After arresting Geweye, a number of the officers placed him in police vehicle, and drove him around for several hours while he remained handcuffed behind his back. He was eventually taken to a precinct and booked on charges of criminal sale of a controlled substance in the third degree. The officers ignored plaintiff's pleas to loosen his handcuffs. He was eventually brought by the officers to Central Booking, and was subject to an unlawful non-private strip search with non-essential employees and other detainees present. He was forced to disrobe completely and walk through a scanner. While plaintiff was in DOC custody, DOC staff denied him access to his medically prescribed Xanax. He was forced to withdraw from Xanax by taking another medication, Librium, which plaintiff informed staff was not the correct medication to withdraw from Xanax. While plaintiff was in custody, the arresting officers, acting in concert, falsely and maliciously told the DA office that plaintiff had committed various crimes, and the DA prosecuted him based on these false allegations. Plaintiff was charged with criminal sale and criminal possession of a controlled substance in the fifth degree, and arraigned after more than 24 hours. The defendant officers maliciously withheld information from the DA showing plaintiff's innocence. On December 31, 2013, plaintiff was released on bail. After working for a few hours, Plaintiff took a break at a nearby Baja Fresh restaurant (1441 Broadway) where he ate dinner for about thirty minutes. Upon leaving at 7:45 PM, he refilled his soda at the soda machine. He returned to his intersection where he saw two acquaintances - Denelle Joly and Gary Foreman - across the intersection. Plaintiff crossed to ask Mr. Joly and Mr. Foreman if either wanted his soda, but  they both declined. After chatting for less than a minute about business, Plaintiff returned to the front of 3 Times Square to continue selling tickets. He saw Mr. Joly go with an unfamiliar woman into the Chase Bank at 3 Times Square. That woman was an undercover police officer (Defendant UC245) to whom Mr. Joly was in the process of selling fake cocaine. After two minutes, Mr. Joly and the Defendant PO exited the bank and then walked in different directions. Mr. Joly saw the Plaintiff and approached him and the two chatted for no more than thirty seconds before Mr. Joly walked away. Soon after, Mr. Joly broke into a sprint as two undercover officers were chasing him; and the officers caught up to him and arrested him. Numerous undercover officers swarmed the area. Plaintiff watched the chaotic scene and saw Mr. Joly being led away in handcuffs by a police officer. Plaintiff noticed that Mr. Joly had dropped his club's promotional materials, so he bent to pick them up. As he bent down, Detective Mantilla stepped behind him and ordered him to put his hands behind his back and told him he was under arrest. Det, Mantilla handcuffed the Plaintiff and searched his pockets and took his bag and cell phone. Plaintiff asked why he was arrested, but Det. Mantilla ignored him. Sergeant Loud told Detective Mantilla to arrest all three of them (including Mr. Foreman and Mr. Joly). \n\nPlaintiff was put in an NYPD van and driven around for over an hour and then taken to the 14th Precinct where he was booked and processed. After about three hours in the holding cells, Plaintiff was transported to Central Booking in Manhattan where he remained until the following evening. On June 11, 2014, around 10 PM, Plaintiff was arraigned and charged with various misdemeanors including: Imitation Controlled Substance, Criminal Possession of Stolen Property, Fraudulent Accosting, and Petit Larceny. Mr. Foreman was a co-defendant. The Complaint against Plaintiff was signed by Det. Vargas, who based his factual allegations on information provided by Defendant UC245. At the arraignment, the New York County District Attorney's Office recommended 2 days of Community Service on a guilty plea to the top charge of Imitation Controlled Substance. Plaintiff pled \"not guilty\" and was released on his own recognizance and ordered to return to Criminal Court on July 21, 2014. On that date, there was an adjournment to September 16, 2014, at which time his case was dismissed for failure to prosecute.
