Defendants NYPD Detectives Faton Alickaj and John Caruso investigated the murder. During their investigation, the defendants requested video recordings of the shooting from the NYCHA, but the time frame for which they requested video tapes ended ten minutes before the murder was actually committed; they omitted the moment of the murder, the most relevant and exculpatory part of the video, from their request, knowing that without an NYPD request to preserve it, NYCHA would erase the recording within 21 days. Although the plaintiff Jamel Fielder did not match the physical description of the shooter given to them by a witness, they provided information to the Bronx DA which resulted in the indictment of Mr. Fielder. On June 14, 2018 Mr. Fielder was arrested. The plaintiff alleges that he was arrested and prosecuted in an attempt to force him to provide information about various crimes. The previous evening, Plaintiff had picked up their 5-year-old granddaughter and their 3-year-old friend to spend the night, with the permission and knowledge of their guardians. Plaintiff woke up the following morning and the 3-year-old was feeling lethargic, so they let them sleep longer, and eventually found them unresponsive. Plaintiff drove the girl to the nearest children's hospital. After some time Plaintiff was taken into a back room and questioned by the police. Plaintiff was released from their custody after answering their questions. Plaintiff later found out that the 3-year-old had passed away from COVID-19 coupled with pneumonia, although Plaintiff had not known that the girl was sick prior to assuming her care. Shortly after receiving this news, five  Bronx police arrived and arrested Plaintiff in front of their granddaughter, restraining them with handcuffs and subjecting them to an unlawful pat-down search. Defendant Officers transported Plaintiff to the precinct where they were detained and interrogated before being transported to Bronx County Central Booking. Defendant Officers provided the District Attorney's office with false and misleading information that Plaintiff was guilty of Endangering the Welfare of a Child causing the death of a minor. In addition, the officers leaked information to a local newspaper alleging they had caused the death of the girl, severely damaging their reputation in the community.
