Plaintiff protested saying that he had been drinking in the bar and was not in a state that he could legally operate his car. Defendants insisted that he move his car. Plaintiff protested that he feared that if he moved his car, he would be arrested for driving while intoxicated. Defendants nevertheless insisted that he move his car, and threatened to have Plaintiff’s car towed if he did not move it. When plaintiff moved his vehicle a minimal distance as directed by defendants, defendants then arrested, detained and held plaintiff. Plaintiff was then maliciously prosecuted by and at the direction of the said defendants. Oliver was legally in the area when he was driving his car with his friend as a passenger. He was pulled over by the police officers for no probable reason. Once he stepped out of his vehicle upon the officers' request, he was handcuffed for no reason. He did not resist this arrest and was illegally searched upon which no illegal material was found. Despite other police officers being present at the site, they did not help to stop misconducts. After being detained for about 24 hours, Oliver made about 6 court appearance: he was charged with crimes he did not commit, but the judge released Oliver with suspension on his driver license. All charges against Oliver were ultimately dismissed. Officer Gingo was previously known for having issues with credibility. Oliver was a truck driver. As a result of Gingo's malicious false, misleading, and/or incomplete reports and the resulting suspension on Oliver's driver license, Oliver lost his job.
